FAQs Concerning Review of Criminal Background to Determine Effect on Licensing

I have criminal background such as criminal charges, arrests, or convictions, with or without expungement or dismissal (“Criminal Background”) and/or engaged in other acts such as regulatory violations, regulatory investigations or discipline and/or have been a party to litigation, and/or engaged in other acts that can potentially affect my license(s) status (“Other Acts”), can your firm provide a phone consultation about this in connection with its effect on my license and/or my duty to disclose and report my Criminal Background and/or Other Acts to my license(s)’ applicable regulator(s) and/or my employer?

Question:

Answer:

My firm does not offer or provide such service through just a phone consultation.

You will need to retain my firm by signing an attorney fee agreement and paying an

initial hourly retainer to be quoted on a case-by-case basis. This requires an extensive

and detailed work and not just a phone call or a “chit chat.”

The typical work to be included is:

  • Review of all applicable documents, including without limitation, the actual

Criminal Background and/or Other Acts court and other documents and

employment agreement(s) if necessary. (your phone or email description of the

Criminal Background and/or Other Acts and employment terms, without my

additional review of the applicable documents is not sufficient).

  • Conducting legal research.

  • Providing legal advice to you (in writing), including citations to legal authority

about the Criminal Background and/or Other Acts’ effect on your license(s)

status, reporting and disclosing duties, advice about which form(s) to be used to

report/disclose, and how to report, as well as assistance with drafting

explanations if applicable and representation in this process before the

applicable regulatory(s) and/or employer(s).

The type of work to be included varies depending on each case’s factual circumstances.
